Agreement Approved Between DEP and Alpha

A federal bankruptcy judge has approved a $39 million agreement between the West Virginia DEP and Alpha Natural Resources to resolve the company’s reclamation obligations. The decision comes just days after the Ohio Valley Environmental Coalition, Sierra Club and the West Virginia Highlands Conservancy filed an objection to the proposal, arguing Alpha needs to provide substitute reclamation bonds backed by a third-party financial institution.
