Magistrate faces accusations of misconduct
Kanawha County Magistrate Carol Fouty was suspended without pay in April amid allegations of misconduct, and her case is making its way through the state Supreme Court. Whether or not she should receive a paycheck has been the issue this week. Her attorney argues that she hasn't been indicted and there are no criminal charges pending. Fouty is accused of misconduct for mishandling several cases in magistrate court, and she is facing five charges that she had relationships with people who appeared before her bench. There are also allegations she mishandled bonds and warrants in serveral cases. Fouty denies the allegations. A decision about the paycheck isn't expected for a week or two.
